十幾年前,外國(guó)人到中國(guó)工作,那個(gè)時(shí)候的外國(guó)人到中國(guó)來(lái),更多的像是一種嘗試,或者旅游,乃至感受生活,體驗(yàn)不同的文化和生活形態(tài)的性質(zhì),他們中很少有人把中國(guó)當(dāng)成自己的家,極少有人能在中國(guó)長(zhǎng)期發(fā)展職業(yè);到了今天,情況有了極大的改變,已經(jīng)極少有人到中國(guó)工作是為了旅游或者感受了文化和生活了,他們來(lái)中國(guó)求職,大多數(shù)是為了職業(yè)的發(fā)展,其中一部分人,已經(jīng)離不開(kāi)中國(guó),或者在中國(guó)已經(jīng)有了婚姻和家庭。外國(guó)人在中國(guó)工作,已經(jīng)漸漸趨于穩(wěn)定,很多已經(jīng)融入了中國(guó)的職場(chǎng)——-和中國(guó)員工做一樣的工作,度一樣的假期,過(guò)一樣的節(jié)日;有的人會(huì)說(shuō):是不是也拿一樣的工資?答案是否定的,因?yàn)橹袊?guó)畢竟沒(méi)有歐美國(guó)家那樣發(fā)達(dá),外國(guó)人在中國(guó)的生活成本還是比本國(guó)人高的,打個(gè)比方:賓館和酒店,如果沒(méi)有相應(yīng)的資質(zhì)和級(jí)別,是不能接待外國(guó)人入駐的。
本文從實(shí)際情況出發(fā),對(duì)于外國(guó)人來(lái)中國(guó)找工作,和就業(yè),給出以下的建議,雖然是給外籍人才的建議,但是對(duì)于中國(guó)的雇主招聘外國(guó)人,也是很有借鑒意義的:
一、關(guān)于工作簽證,工作許可和居留許可
這個(gè)是外籍人士到中國(guó)工作首先遇到的問(wèn)題,有的外國(guó)人曾經(jīng)問(wèn)我們:如果我自己能解決工作簽證的問(wèn)題,是不是就不用雇主幫我解決了,這樣我找工作可選的范圍是不是就更大了?我們的回復(fù)是:不能。即使你之前的簽證沒(méi)有到期,在中國(guó)找到雇主之后,你的工作許可的流程都要按照規(guī)定辦理,即使你之前有工作簽證,那并不是你的新雇主給你辦理的,你的工作關(guān)系也不隸屬今后的新的雇主,所以你目前有工作簽證在有效期里,僅僅是給了你更長(zhǎng)時(shí)間可以在中國(guó)逗留,并能找到更多的面試機(jī)會(huì)而已,找到新的工作之后,工作許可,居留許可這些流程都是要重新辦理的。
還有的朋友問(wèn)我們:我是隨著婚姻的關(guān)系來(lái)到中國(guó)的,在中國(guó)有長(zhǎng)期居留的權(quán)利,是不是找到工作之后,就可以直接工作就可以了?答案也是否定的,你持別的類型的簽證,僅僅是保證你在中國(guó)有居留的權(quán)利,并不代表著你能在中國(guó)工作,在中國(guó)工作,就需要持工作簽證,持工作許可證和相應(yīng)的居留許可。一言以蔽之:持什么樣的簽證,在中國(guó)就做什么樣的事情,持其他任何種類的簽證在中國(guó)工作,均屬非法。
還有很多朋友問(wèn)我們:如果雇主問(wèn)我能不能自己辦理工作簽證和工作許可,他們給我們足夠的薪水就可以了,這個(gè)可以嗎?回答也是否定的,一個(gè)雇主雇傭外國(guó)人,那么給外國(guó)人申請(qǐng)工作邀請(qǐng)函,外國(guó)人持(雇主申請(qǐng)辦理的)工作邀請(qǐng)函申請(qǐng)來(lái)華工作簽證,到中國(guó)之后辦理工作許可證和居留許可,這個(gè)是一整套的合法手續(xù),必須雇主牽頭,外籍員工緊密配合去辦理,外國(guó)人自己是無(wú)法申請(qǐng)的。
如果一個(gè)雇主要招聘外國(guó)人,明確說(shuō)明自己沒(méi)有能力去申請(qǐng)工作簽證,工作許可這些手續(xù),那這個(gè)工作機(jī)會(huì)根本就不是正規(guī)的工作機(jī)會(huì),建議你放棄。
二、關(guān)于外國(guó)人來(lái)華工作應(yīng)該達(dá)到的條件
本文不討論外籍專家來(lái)中國(guó)工作需要達(dá)到的條件,如果你是中國(guó)緊缺領(lǐng)域的專家,所有的手續(xù)都簡(jiǎn)單的多,相關(guān)部門(mén)也有專門(mén)的通道協(xié)助你辦理,不在本文的介紹之列。本文針對(duì)的是大多數(shù)在職業(yè)市場(chǎng),人才市場(chǎng)找工作的人,所以針對(duì)的也是大多數(shù)達(dá)不到“專家”資歷的人。
1、 必須持等同于大學(xué)學(xué)歷的畢業(yè)證書(shū)(Bachelor Degree Certificate or above),這個(gè)畢業(yè)證書(shū)需要經(jīng)過(guò)中國(guó)駐當(dāng)?shù)貒?guó)的使領(lǐng)館認(rèn)證的,比如你是西班牙人,你的大學(xué)學(xué)歷證書(shū),需要中國(guó)駐西班牙當(dāng)?shù)氐氖诡I(lǐng)館認(rèn)證,否則無(wú)效。

三、關(guān)于外國(guó)人在中國(guó)工作的社保和醫(yī)療等的問(wèn)題
早在2011年9月,中國(guó)人社部就已經(jīng)就此問(wèn)題發(fā)文,《在中國(guó)境內(nèi)就業(yè)的外國(guó)人參加社會(huì)保險(xiǎn)暫行辦法》 ( 中華人民共和國(guó)人力資源和社會(huì)保障部令第16號(hào)),文件中已經(jīng)有明確的規(guī)定,目前還沒(méi)有更新的政策出現(xiàn),所以外籍人才,在中國(guó)就業(yè),應(yīng)該按照此文件辦理。
其實(shí)概括來(lái)講,就是外國(guó)人在中國(guó)就業(yè),也需要用人單位繳納“五險(xiǎn)”,繳納辦法和本地員工基本一致,關(guān)于“一金”的問(wèn)題,就是住房公積金,現(xiàn)實(shí)操作的過(guò)程中,很多單位以租房補(bǔ)貼的方式進(jìn)行替代,其實(shí)外籍人士在中國(guó)租房,很大一部分可以列入企業(yè)的經(jīng)營(yíng)費(fèi)用,抵減稅費(fèi)支出,這也是對(duì)于外國(guó)人沒(méi)有“一金”的補(bǔ)償。
在前些年的實(shí)際操作的過(guò)程中,我們時(shí)不時(shí)接到電話,咨詢這個(gè)問(wèn)題,因?yàn)檫@個(gè)文件是2011年就發(fā)布的,其實(shí)從那個(gè)時(shí)候起,到現(xiàn)在,執(zhí)行此文件的力度正在逐漸增強(qiáng),實(shí)際操作中,很多公司都是按照這個(gè)文件的要求去執(zhí)行的。我們也碰到一些朋友單位說(shuō):有的外國(guó)人不想讓單位按照規(guī)定繳納“五險(xiǎn)”,他們希望單獨(dú)購(gòu)買商業(yè)醫(yī)療保險(xiǎn),他們更看重這個(gè),我們的回復(fù)是:既然中國(guó)有此項(xiàng)規(guī)定,還是盡量按照規(guī)定進(jìn)行辦理,如果外國(guó)人比較看重商業(yè)醫(yī)療保險(xiǎn)(他們不太想到中國(guó)的醫(yī)院去排隊(duì)看病),你們可以另行協(xié)商辦理。

This is the first problem for foreigners to work in China. Our response is: No. Even if your previous visa has not expired, after you find an employer in China, your work permit process must be processed in accordance with the regulations. 2. Requirements for Foreigners to Work in China
This article does not discuss the requirements for foreign experts to work in China. If you are an expert in a scarce field in China, all the procedures are much simpler, and the relevant departments have special channels to assist you with this, which is not included in the introduction of this article. This article is aimed at most people who are looking for a job in the job market and the talent market, so it is also aimed at the majority of those who cannot reach the “expert” qualifications.
1. You must hold a Bachelor Degree Certificate or above. This diploma needs to be certified by the Chinese embassy or consulate in the local country. For example, if you are Spanish, your university diploma requires a Chinese diploma. Spanish local embassy or consulate certification, otherwise invalid.
2. After receiving the undergraduate certificate, a certificate of full-time related work experience of more than 2 years. This must be issued to you by your previous employer.
